1. General provisions

1.1. These terms govern the relationship between NIKI APART EOOD (hereinafter “the Trader” or “we”) and the users of the website at nikiapart.com (hereinafter “the Website”) when browsing and using it, including when you send an inquiry or make a booking for any of the NIKI APART apartments through the Website, by phone or by email.

1.2. By using the Website, you accept these terms. You can read, save and print them at any time from this page.

1.3. Where the user is a consumer within the meaning of the Consumer Protection Act (a natural person acting for purposes outside their trade or profession), all rights granted to them by law also apply. Nothing in these terms limits those rights.

1.4. If a separate contract has been signed with you or an individual offer has been sent to you, they take precedence over these terms.

2. Trader details

3. Definitions

• User – any person who browses or uses the Website.
• Consumer – a natural person who buys products or uses services for purposes outside their trade or profession.

4. Use of the website

4.1. Access to the Website is free and unrestricted. The costs of the internet connection are borne by the user.

4.2. The user shall use the Website in good faith and in accordance with the law. It is not permitted to disrupt the operation of the Website, to attempt unauthorised access to it, or to send malicious code, spam or content that violates the law, the rights of others or good morals.

4.3. The information on the Website is for information purposes only. We strive to keep it accurate and up to date, but it may be changed without notice.

4.4. The Website may contain links to third-party websites. These websites are not operated by us and are subject to their own terms.

4.5. We may restrict the access of a user who breaches these terms.

5. Intellectual property

5.1. The content of the Website (texts, photos, logos, design) is the property of the Trader or is used with permission. Its use without written consent is prohibited.

6. Liability

6.1. The Website may be temporarily unavailable due to maintenance or technical reasons. The Trader is not liable for damages resulting from such an interruption.

6.2. The Trader is not liable for the content or operation of third-party websites linked from the Website.

6.3. The Trader is not liable for non-performance caused by force majeure (natural disasters, fires, strikes, supply interruptions, actions of public authorities, etc.). In such a case, the deadlines are extended by the duration of the event and we will notify you without delay.

6.4. The limitations of liability in these terms do not affect liability for damages caused intentionally or through gross negligence, nor the statutory rights of consumers.

7. Personal data

The Trader processes the personal data you provide when you send us an inquiry through the form on the Website, write to us or call us, in order to respond to you and to fulfil its legal obligations. The details (what data, why, how long we keep it and what rights you have) are described in the Privacy Policy, and the use of cookies in the Cookie Policy.

8. Dispute resolution

8.1. We will try to resolve any dispute through discussion. Write to us at info@nikiapart.com.

8.2. As a consumer, you can file a complaint with the Consumer Protection Commission or contact the General Conciliation Commission for out-of-court resolution of consumer disputes. A list of alternative dispute resolution bodies is published on the website of the Consumer Protection Commission. If you live in another EU country, you can also contact the European Consumer Centre Bulgaria.

8.3. If the dispute is not resolved in this way, it shall be referred to the competent Bulgarian court.

8.4. These terms and contracts with the Trader are governed by Bulgarian law. If you are a consumer habitually resident in another EU country, you retain the protection of the mandatory rules of that country.

9. Amendments and applicable law

9.1. The Trader may amend these terms. Amendments are published on this page with a new effective date and apply from that date.

9.2. If any provision proves to be invalid, this does not affect the remaining provisions.

9.3. Matters not regulated herein are governed by the Obligations and Contracts Act, the Consumer Protection Act, the Electronic Commerce Act, the Copyright and Related Rights Act and other Bulgarian legislation.

9.4. These terms are effective from 02.11.2026.

10. Inquiries and bookings

10.1. You can request information or book a stay in any of the NIKI APART apartments by phone (0885 814 403), by email (info@nikiapart.com) or using the inquiry form on the home page of the Website.

10.2. The Website does not accept online bookings or payments. Sending an inquiry through the form is not a booking and does not commit you to anything. In the inquiry you state the apartment, the check-in date and the number of nights, and we reply by phone or email whether the apartment is available and on what terms.

10.3. The terms of the stay (price, method and deadline of payment, deposit, cancellation terms, check-in and check-out times, number of guests and the house rules of the apartment) are agreed with you individually at the time of booking. The booking is confirmed when we confirm it to you by phone or in writing (email or message) with the agreed terms.

10.4. The information about the apartments on the Website (descriptions, photos, amenities) is for information purposes only and does not constitute an offer. The photos are illustrative and the furnishings may differ slightly.

10.5. If you are a consumer, the right of withdrawal from distance contracts under the Consumer Protection Act does not apply to accommodation services for which a specific date or period has been agreed (Art. 57, item 12 of the Act). The possibility and terms of cancelling the booking are agreed at the time of booking under item 10.3.
